EU AI Act, GDPR, and US patchwork as operating model specs — and five missteps to avoid
The Gap the Literature Left
Thirty-two research sources. Eighteen reports from organisations, including Gartner, McKinsey, Deloitte, MIT, and TI People. Fourteen practitioner artefacts. All are produced to help HR leaders understand how AI is reshaping the operating model.
Not one engages substantively with the regulatory environment that governs that reshaping.
That is not a minor oversight. The EU AI Act has been in force since August 2024. GDPR's automated decision-making provisions have been in force since 2018. New York City's Local Law 144 has been in force since July 2023. The regulatory architecture has arrived. And most HR functions are designing operating models without reference to it because the dominant literature they rely on has not told them it exists.
Not through negligence. Through a gap in the information they have been given.
This Note identifies the most common design missteps that gap produces, and what it looks like to treat regulation as a design specification rather than a compliance retrofit.
Five Design Missteps — and What They Produce
Misstep One: Treating conformity assessment as a post-deployment filing.
The EU AI Act's conformity assessment is not a regulatory notification submitted after an AI system is operational. It is a pre-deployment evaluation — a systematic assessment against defined quality management, risk management, and technical documentation standards that must be completed before the system is placed into service.
Organisations that deploy AI systems in high-risk HR process areas and then address conformity assessment as a subsequent compliance step have not delayed their compliance. They have been operating non-compliant systems from day one. The assessment cannot be completed retroactively to make the prior operation compliant. The cost of retrofitting conformity assessment and logging into a live system typically exceeds the cost of designing for them upfront — but arrives as unplanned spend under pressure.
Misstep Two: Confusing data retention with audit trail.
The EU AI Act's logging requirement is not a data retention policy. It specifies that high-risk AI system operations must be logged at sufficient granularity to enable post-hoc reconstruction of how a given output was produced — what data the system operated on, what logic it applied, what confidence levels it assigned, and what the human reviewer saw at the point of review.
Most organisations have data retention policies. Most do not have logging infrastructure that meets this specification. A data retention policy preserves existing records. An audit trail generates records that enable reconstruction. A system not architecturally designed to generate those records cannot be made compliant by retaining whatever records it does produce. The logging architecture must be specified before the system is built.
Misstep Three: Assuming vendor indemnity transfers regulatory liability.
The EEOC's guidance on AI and employment decisions is direct: employers remain liable for discriminatory AI outcomes even when the tools producing those outcomes were developed and operated by third-party vendors. Liability does not transfer to the vendor. The same logic applies under the EU AI Act — the deploying organisation carries the compliance obligation, not the developer.
The vendor's indemnity provisions may limit the parties' commercial liability. They do not limit regulatory liability to the regulator or legal liability to the employee affected by an AI-influenced employment decision. Organisations that have not assessed their third-party AI deployments against their own compliance obligations — rather than against vendor representations — have unmapped exposure.
Misstep Four: Building rights-exercise as a post-complaint process.
GDPR establishes specific rights for employees whose personal data is processed by automated systems: the right to contest solely automated decisions, the right to human review, the right to an explanation of AI logic, and the right to contest AI-influenced outcomes. These rights must be exercisable — operationally supported — from the moment the AI system goes live.
Most HR functions have not built this infrastructure. The employee-facing communication about AI use in HR decisions is typically absent or buried in privacy notices. The pathway to request human review of an AI-influenced decision typically does not exist as a distinct, accessible, operationally supported process. Building this infrastructure as a post-complaint process means building it under time pressure, without the design quality that pre-deployment construction allows, and after the trust deficit with the workforce has already been created.
Misstep Five: Treating governance as a workstream rather than a design input.
The most pervasive misstep is sequencing. The operating model is designed. The technology is deployed. The governance workstream runs in parallel, scheduled to deliver its outputs after the system is live. This sequencing treats governance as something that constrains a completed operating model, which means it consistently arrives too late to shape the architecture decisions that governance requirements need to inform.
Audit trail architecture must be specified before the system is built. Human oversight mechanisms must be designed into the workflow before the workflow is deployed. Data governance standards must be assessed before the training data is used. Conformity assessment must be completed before the system goes live. None of these can be retrofitted to the quality and completeness required by compliance.
What Treating Regulation as Design Specification Looks Like
The alternative to these missteps is not more compliance activity. It is a different sequencing decision: regulatory requirements enter the operating model design process before architecture decisions are made.
In practice, this means three things. Regulatory classification is assessed before vendor selection — knowing whether a system will be high-risk under the EU AI Act changes the technical and governance requirements that vendor evaluation must assess. Audit trail and oversight architecture are specified in the system design brief — not added after the system specification is complete. And governance gates are built into the deployment process — in practice, a formal sign-off with Legal, HR, and IT confirming conformity assessment status, oversight design, and logging capability before any system moves to production.
That sequencing produces operating models that age well. The governance infrastructure built for regulatory compliance is also the infrastructure that enables performance monitoring, bias detection, and continuous improvement of AI systems in production. The investment profile shifts: more upfront in design and specification, substantially less in remediation, retrofit, and regulatory response.
Organisations that read the regulatory environment accurately — and design for it rather than around it — are not being cautious. They are building operating models that will remain legally deployable as regulatory scrutiny intensifies. That is a competitive advantage, not a constraint.
